UPDATE: Polish President signs windfall tax bill into law

Polish President Karol Nawrocki has signed into law a bill introducing a windfall tax on oil companies and referred it to the Constitutional Tribunal for review, the President said on Thursday.

In a statement, Nawrocki called on the government to lower fuel prices.

"Price cuts at gas stations are to take effect immediately and should bring fuel prices down to the level promised to Poles during the election campaign. Every zloty generated by this law must be spent on lowering fuel prices," he said.

"The funds must also go directly to Polish farmers," he added.

Nawrocki said he expects the agricultural fuel rebate to be increased to a level that restores the profitability of agricultural production. He also called on the Sejm to begin work on his own draft legislation aimed at lowering fuel prices.

On September 18, the Sejm once again passed the bill introducing a tax on windfall profits earned by oil companies. The new regulations are to apply from March 2026 through the end of the first quarter of 2027. On September 24, the Senate passed the bill without amendments.

Separately, Nawrocki submitted his own draft bill to the Sejm aimed at lowering fuel prices. The proposal includes cutting the retail fuel tax to zero until the end of March 2027, allowing the Finance Ministry to temporarily reduce excise duty rates and introducing a statutory cap on fuel companies’ profit margins.

At the end of July, Nawrocki referred the bill imposing a tax on extraordinary profits generated from the sale of liquid fuels between March and December 2026 to the Constitutional Tribunal for preventive review. In his explanatory statement, Nawrocki pointed, amongst other things, to the retroactive nature of the provisions.
