„TP is doing everything to prevent anyone from threatening its dominant market position because millions of złoty are at stake. This is causing trouble because it is holding off the changes needed by the market,” says UKE‘s spokesperson Jacek Strzałkowski, adding that TP won‘t be able to use these methods forever. „We have a whip we can and probably will have to use. This whip is called European benchmarks. We have the right to use them if there are problems with the domestic dominant provider‘s statements.”
TP decided to mount a legal challenge to UKE‘s decision, which it calls „biased.” TP argues that UKE accepted the same calculation statement while recognizing some of TP‘s earlier tariff plans. However, alternative providers say UKE‘s decision was appropriate, and that basing the fees on TP‘s statements would have resulted in unjust and unreasonable prices.
„This is but another attempt by TP to make alternative providers pay large amounts of money,” private operator Netia‘s director of PR and communications, Jolanta Ciesielska, says. „TP has been stubbornly proposing one of the highest rates in the EU, if not the highest, totally out of any European existing benchmarks.”
