Polkomtel loses in court

Polkomtel, the operator of Plus GSM, claimed that technical tests between the operators weren't carried out, because the necessary agreements haven't been signed. "There can be no agreements without so-called operator interface and URTiP doesn't want to give us the requirements for such an interface," Piotr Naszkowski of Polkomtel said. However, URTiP claims that it is not within its competences to set technical requirements, and the court ruled in its favor. The verdict stated that URTiP neither has the right nor duty to assist the operators in fulfilling their obligations.

However, the verdict does not mean that the service will be launched according to the timetable, as Polkomtel's legal adviser Elżbieta Barenbuch said that she would advise the company to appeal the verdict to the Supreme Administrative Court (NSA). What's more, in October the court in Warsaw will decide on appeals against the timetable by PTC and Centertel, the operators of Era and Orange respectively.

According to the timetable prepared by the Office of Telecommunications and Post Regulations (URTIP), starting on October 10 all mobile-phone subscribers should be able to keep their old numbers while changing the operator. Although the decision to introduce number portability has been postponed a number of times over the past years, all three operators challenged the regulator's decision to finally introduce the service in October and went to court.
