Change in rent increase regulations

The regulations governing rent increases by landlords in leased commercial premises may be significantly changed due to the Sejm's adoption, on 9 January 2003, of the draft law amending the Civil Code. At present, a landlord may increase the rent in lease agreements concluded for specified and unspecified period of time with one-month's notice. The amendment adopted by Sejm limits the possibility of increasing the rent by notice only to the lease agreements concluded for an unspecified period of time. It implies that, if lease agreements concluded for a specified period of time do not contain clauses allowing rent increases, then the rent cannot be increased until the end of the term of the lease agreement. It is also worth mentioning that, according to the adopted draft law, the new limitation on rent increases for limited period lease agreements will also be applied to agreements concluded before the new law came into force.
At present, the draft law is being debated by the Senate. If the new amendments are adopted and the draft law is signed by the President of Poland, the changes in the rent increase regulations will come into force 30 days after the publication of the law in the Journal of Laws.
