08.01. Warszawa (PAP) - Polacy pracujący w Norwegii, których dochód został już opodatkowany w tym kraju, nie będą musieli płacić PIT w Polsce - zakłada uchwalona w piątek przez Sejm polsko-norweska umowa o unikaniu podwójnego opodatkowania.

Nowe przepisy wprowadzają dla opodatkowania dochodów z pracy w Norwegii tzw. metodę wyłączenia z progresją. Oznacza ona, że dochód osiągnięty za granicą jest brany pod uwagę przy obliczaniu stawki podatkowej, według której należy opodatkować dochody w Polsce. Np. jeżeli w Polsce podatnik zarobi 10 tys. zł, a w Norwegii równowartość 100 tys. zł, to w Polsce zapłaci jedynie podatek od 10 tys. zł, ale ze stawką podatkową właściwą dla dochodu w wysokości 110 tys. Za 2010 r. będzie to 32 proc., a nie 19 proc., która to stawka byłaby właściwa dla 10 tys. zł.

W inny sposób liczone będzie opodatkowanie od dywidend czy innych zysków majątkowych. W tym wypadku zastosowanie znajdzie tzw. zasada proporcjonalnego odliczenia. Oznacza ona, że podatek musi być płacony odpowiednio od dochodów uzyskanych w każdym z krajów, w których zostały one uzyskane.

Nowa polsko-norweska konwencja o unikaniu podwójnego opodatkowania jest oparta na modelowej konwencji OECD w sprawie podatku od dochodu i majątku z lipca 2005 r. Podobne umowy Polska zawarła już m.in. z Niemcami, Szwecją, Wielka Brytanią i Irlandią.

Jak mówili w Sejmie posłowie, nowe zasady unikania podwójnego opodatkowania będą dotyczyć ok. 300 tys. Polaków pracujących w Norwegii.
