| Zarząd spółki Energa SA („Spółka") informuje, że Spółka otrzymała od Sądu Okręgowego w Gdańsku, IX Wydział Gospodarczy, odpis pozwu o uchylenie uchwały nr 5 Zwyczajnego Walnego Zgromadzenia Energi SA z dnia 15 czerwca 2023 r. w sprawie podziału zysku netto za rok obrotowy 2022 i przeznaczenia tego zysku na podwyższenie kapitału zapasowego. Spółka nie zgadza się z wniesionym pozwem i złoży na niego odpowiedź w terminie i w sposób przewidziany przez obowiązujące przepisy prawne. |

| Current report No. 24/2023 Date: 21 August 2023 Subject: Statement of claim for the repeal of the resolution of Energa SA’s Ordinary General Meeting Legal basis: Art. 56 section 1 point 2 of the Act on Offerings - current and periodic information The Management Board of Energa SA ("Company") informs that the Company received from the Regional Court in Gdańsk, 9th Commercial Division, a copy of the statement of claim for the repeal of the resolution No. 5 of the Ordinary General Meeting of the Company on 15 June 2023 on the distribution of the net profit for the financial year 2022 and allocation of this profit to increase of the supplementary capital. The Company does not agree with the statement of claim and will submit a statement of defence within the time limit and in the manner prescribed by the applicable legal regulations. |
